In the future, companies in the European Union will have to systematically record the working hours of their employees. This is now certain following the latest landmark ruling by the Federal Labor Court (BAG) in Luxemburg in December 2022. For some industries and occupational groups—such as the construction industry, the hospitality industry or public authorities—this precise recording of productive times has long been part of everyday life. Otherwise, the so-called “trust-based working time model” still applies in many areas. In other words, the focus is on getting the job done, not keeping a close eye on the clock. However, this model has its pitfalls: it harbors the risk of overworking employees. This is precisely the argument used by proponents of the new, stricter timekeeping system.
